General Terms and Conditions

Daniel Hauck – AI Workshops and “LYF – Lead Yourself First”

These Terms consist of three parts. Part A applies to all agreements. Part B additionally applies to AI workshops, which can be booked by businesses only. Part C additionally applies to the LYF offerings Accelerator, Membership, and Plus. The withdrawal notice for consumers is in Section C9.

Part A – General Provisions

A1 Provider, Scope

(1) The provider is Daniel Hauck, Friedhofstr. 21, 71577 Großerlach, Germany, email: dh@hauck.io, phone: +49 176 30400873 (“Provider”).

(2) These Terms apply to all agreements between the Provider and its customers for the services offered at https://danielhauck.net. Part B applies only to AI workshops, Part C only to LYF offerings. Where Part B or Part C deviates from Part A, Part B or Part C prevails.

(3) Individual agreements, in particular in a written proposal, take precedence over these Terms.

(4) Any deviating or supplementary terms of the customer are rejected. They only become part of the agreement if the Provider expressly agrees to them in text form.

A2 Definitions

(1) A “consumer” is any natural person who enters into an agreement predominantly for personal purposes (Section 13 of the German Civil Code, BGB). A “business” is any natural or legal person or partnership with legal capacity acting in the course of its trade, business, or profession (Section 14 BGB).

(2) The “Customer” is the Provider’s contracting party. A “Participant” is the person taking part in a service. If a company books for its own employees, the company is the Customer and the employees are Participants.

A3 Nature of the Services

(1) The Provider renders services under a service agreement (Section 611 BGB). The Provider owes the careful performance of the agreed services, not a specific result.

(2) The services do not constitute legal, tax, medical, or psychotherapeutic advice.

A4 Contract Language

Agreements may be concluded in German or English. The language in which the Customer books, or in which the proposal was issued, governs.

A5 Confidentiality

The Provider and any persons it engages treat as confidential all information about the Customer or Participants that becomes known to it in the course of the collaboration. They do not disclose such information to third parties unless required by law, necessary to perform the agreement, or consented to. This obligation survives the end of the agreement.

A6 Liability

(1) The Provider is liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and to the extent of any guarantee given.

(2) For ordinary negligence, the Provider is liable only for breach of a material contractual obligation. A material obligation is one whose fulfillment is essential to the proper performance of the agreement and on whose observance the Customer may regularly rely. In that case, liability is limited to the foreseeable damage typical for this type of agreement.

(3) Any further liability is excluded. Paragraphs 1 and 2 also apply to the Provider’s agents.

A7 Data Protection

The Provider processes personal data as described in the Privacy Policy at https://danielhauck.net/privacy-policy/.

A8 Governing Law, Jurisdiction

(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the Customer is a consumer, this choice of law applies only to the extent it does not deprive the consumer of the protection of mandatory provisions of the country of their habitual residence.

(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from the agreement is the Provider’s place of business.

A9 Dispute Resolution

The Provider is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

A10 Final Provisions

Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.

Part B – AI Workshops (Businesses Only)

B1 Scope

(1) Part B applies to the Agentic Engineering Workshop, the Agentic Everything Hackathon, and other AI trainings by the Provider (“Workshop”).

(2) Workshops are offered to businesses only. By placing an order, the Customer confirms that it is acting as a business.

B2 Formation of the Agreement

(1) The descriptions on the website are non-binding. On request, the Provider provides a proposal. If it states a validity date, it is valid until that date.

(2) The agreement is formed when the Customer orders the Workshop in text form (e.g., by email) and the Provider confirms the date in text form. Scope, dates, location, number of Participants, and price are set out in the proposal and the date confirmation.

B3 Services

(1) A Workshop lasts two days and takes place on-site at the Customer’s premises or remotely, with up to twelve Participants, in German or English. Remote Workshops are held entirely live by video conference; the Provider is available for questions throughout the Workshop, including during work sessions. No recordings are provided for later viewing.

(2) The Agentic Engineering Workshop includes preparation and a setup checklist, which the Provider sends about one week in advance.

(3) The Agentic Everything Hackathon additionally includes a kickoff call about two weeks in advance and a template for mapping workflows (e.g., for Miro).

(4) Follow-up individual sessions after the Workshop are provided only if agreed in the proposal.

B4 Customer’s Cooperation

(1) The Customer ensures that, before the first Workshop day, all Participants have a laptop, working access to the agreed AI tools, and everything listed in the setup checklist. For the Agentic Engineering Workshop, this includes a working development environment and at least one real project per group. For the Hackathon, this includes the preparation (approx. two hours per person) and two mapped problems per Participant.

(2) The Customer provides licenses and access to AI tools at its own expense. For on-site Workshops, the Customer provides a suitable room with internet access and presentation equipment.

(3) Delays or limitations resulting from a lack of cooperation are not the Provider’s responsibility. The Provider’s right to payment remains unaffected.

B5 Fees, Payment

(1) All prices are net, plus statutory VAT. Travel expenses are charged as set out in the proposal.

(2) 50% of the fee is due after order confirmation and 50% after the Workshop has been held, each within 14 days of invoicing. Individual sessions are billed based on actual use.

B6 Cancellation, Rescheduling

(1) If the Customer cancels an agreed Workshop, the following applies:

  • more than four weeks before the date: free of charge,
  • two to four weeks before the date: 50% of the agreed fee,
  • less than two weeks before the date: 100% of the agreed fee.

The Customer remains free to prove that the Provider incurred no loss or a significantly lower loss. Non-refundable travel costs already incurred are reimbursed in addition.

(2) The Workshop may be rescheduled once free of charge if the Customer gives notice more than two weeks before the original date and an alternative date within six months is available.

(3) If the Provider cannot hold a Workshop for good cause (e.g., illness), the parties agree on an alternative date. If none is agreed, the Provider refunds any amounts already paid. Further claims exist only under Section A6.

B7 Rights of Use

(1) The Provider’s materials (e.g., slides, playbook, templates, checklists) remain the Provider’s copyrighted property. The Customer receives a simple, perpetual, non-transferable right to use them internally. Passing them on to third parties or publishing them requires the Provider’s consent in text form.

(2) Work results created by Participants during the Workshop (e.g., skills, specs, code, prototypes, mapped workflows) belong to the Customer. The Provider may continue to use general knowledge and methods that are not specific to the Customer.

B8 Confidentiality, Customer Code and Data

(1) Participants work in the Customer’s own systems and tools. The Provider does not receive its own access to these systems and does not create or store copies of the Customer’s code or data. The Provider sees them only when Participants share their screen.

(2) On request, the Provider signs a separate non-disclosure agreement (NDA) before the Workshop.

(3) The Customer ensures that, as far as possible, no personal data of third parties is visible on shared screens, preferably by using test or anonymized data.

(4) The Customer decides which data it enters into AI tools and is responsible for their privacy settings. The Customer reviews the output of AI tools before any production use.

Part C – LYF – Lead Yourself First

C1 Scope, Offerings

(1) Part C applies to the offerings “LYF Accelerator,” “LYF Membership,” and “LYF Plus,” for both consumers and businesses unless stated otherwise. Where these offerings are referred to on the website or on social media as “Leadership” or “Leadership Coaching,” this refers exclusively to these offerings, with the scope of services described in Section C2.

(2) The offerings are intended for adults with full legal capacity. By booking, the Participant confirms that they are at least 18 years old.

C2 Services

(1) All offerings include access to the LYF app for iOS and Android, in German and English. The app includes a daily prompt (push notification at 9:00 a.m. German time), the four daily non-negotiables, a journal, completion tracking, and templates for reviews. There is no web version.

(2) LYF Accelerator (90 days, starting with a fixed group of up to twelve Participants on a fixed date):

  • one individual video call before Day 1,
  • a weekly group call for the Participant’s own group only, Sundays at 10:30 a.m. German time, one hour,
  • prompt texts on the four phases in the app,
  • contact with the Provider via WhatsApp; if the Participant goes quiet for a while, the Provider reaches out.

(3) LYF Membership (12 months): the app as described in paragraph 1 only. Calls, phase texts, and personal support are not included. If the Participant has provided a mobile number, the Provider may send a reminder via WhatsApp after a longer period of inactivity.

(4) LYF Plus (12 months):

  • a weekly Plus call with all Plus Participants, Sundays at 9:30 a.m. German time, one hour,
  • once per quarter, an in-depth reflection session with the group,
  • contact with the Provider via WhatsApp; if the Participant goes quiet for a while, the Provider reaches out.

(5) No individual sessions are included beyond the one individual call in the Accelerator. Individual sessions can be booked separately on request (Section C11).

(6) Calls take place by video (Zoom or Google Meet). They are held in English, or in German if only German-speaking Participants attend. Calls are not recorded. Missed calls are not made up or refunded. If a call is canceled for reasons on the Provider’s side, it is rescheduled or replaced by an additional session.

(7) Contact via WhatsApp comes without a guaranteed response time. It is not an emergency or crisis service.

(8) The offerings support personal development and self-reflection; they do not teach knowledge or skills. The Participant carries out the daily non-negotiables on their own responsibility. The Provider does not review, evaluate, or correct the Participant’s content. Success depends largely on the Participant’s active, self-directed participation; the Provider does not owe any particular result, such as achieving individual goals.

(9) In the app, the Provider can see the completion status (done/not done), not the content of the journal. Journal entries are shared with the Provider or the app’s AI feature only if the Participant expressly releases the individual entry.

C3 Formation of the Agreement

(1) The presentation of the offerings on the website is not a binding offer. Joining the waitlist is non-binding and does not create a right to a spot.

(2) By clicking the “Book and pay” button, the Participant submits a binding offer. Before submitting, the Participant can review and correct their details.

(3) The agreement is formed when the Provider confirms the booking by email. The confirmation contains the content of the agreement, these Terms, and the withdrawal notice. The Provider stores the text of the agreement.

C4 Prices, Payment

(1) The prices displayed on the website at the time of booking apply. All prices are final prices including statutory VAT.

(2) The Accelerator is payable in advance as a one-time payment. Membership and Plus are payable annually in advance. The Provider may offer installment payments through the payment provider; their terms are displayed before booking.

(3) Participants who have taken part in a LYF Accelerator can book LYF Plus at any time afterward at a reduced alumni price. The alumni price applies to the initial 12-month term; after that, the regular Plus price applies. Both prices are displayed on the website before booking.

(4) The Provider may offer time-limited discount promotions. Other Participants have no claim to the same discount.

(5) Payment is processed via Stripe using the payment methods offered there.

(6) In the event of late payment, the Provider may charge statutory default interest (Section 288 BGB).

C5 Start of Services

(1) The Accelerator begins for all Participants of a group on the start date communicated in advance. The Participant receives app access and a link to schedule the individual call before then.

(2) Membership and Plus begin with the booking confirmation.

(3) If the Participant is a consumer, the Provider begins services within the withdrawal period only if the Participant expressly requested at booking that the Provider begin before the withdrawal period expires and acknowledged that they owe compensation for the services provided up to that point if they withdraw (Section C9).

C6 Term, Termination

(1) The Accelerator runs for 90 days from the start date and ends automatically. Ordinary termination is excluded.

(2) Membership and Plus have an initial term of 12 months from their start. They can be canceled with one month’s notice, effective no earlier than the end of the initial term.

(3) If not canceled, Membership and Plus continue for an indefinite period after the initial term. They can then be canceled at any time with one month’s notice. Billing continues annually in advance at the existing price; Participants who booked Plus at the alumni price pay the regular price shown at booking from the second year on (Section C4(3)). Upon cancellation, the Provider refunds the portion of the annual payment attributable to the time after the agreement ends.

(4) Cancellation is possible in text form (e.g., email) or via the cancellation button on the website (Section 312k BGB, the German statutory requirement for an easy online cancellation feature). The Provider confirms it electronically without delay.

(5) Either party’s right to terminate for good cause remains unaffected.

C7 Health Notice

(1) LYF does not replace medical, psychotherapeutic, or psychiatric treatment. Anyone in an acute crisis, with an acute mental health condition, or in ongoing treatment should check with their doctor or therapist before booking whether LYF is right for them.

(2) If it becomes apparent that a Participant’s needs go beyond support for self-reflection, the Provider may terminate the agreement for good cause and will, where possible, point to appropriate resources. Unused amounts are refunded on a pro-rata basis.

(3) The Participant chooses movement and other activities themselves and assesses their own physical condition on their own responsibility.

C8 Data in the App

(1) The Provider may temporarily access the Participant’s account solely for support and troubleshooting purposes.

(2) The individual call in the Accelerator and individual sessions under Section C11 are recorded only if the Participant consents in advance.

(3) App access and stored data are deleted 30 days after the agreement ends, unless statutory retention obligations apply. Participants who book Membership or Plus after the Accelerator keep their data.

C9 Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal.

Withdrawal Notice

Right of Withdrawal

You have the right to withdraw from this agreement within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the agreement was concluded.

To exercise your right of withdrawal, you must inform us (Daniel Hauck, Friedhofstr. 21, 71577 Großerlach, Germany, email: dh@hauck.io, phone: +49 176 30400873) of your decision to withdraw from this agreement by a clear statement (e.g., a letter sent by post or an email). You may use the model withdrawal form below, but it is not required. You can also exercise your right of withdrawal online at https://danielhauck.net using the “Withdraw from contract” button in the page footer. If you use this online function, we will send you, without undue delay, an acknowledgement of receipt on a durable medium (e.g., by email) containing information on the content of your withdrawal and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this agreement, we will reimburse all payments received from you without undue delay, and in any event no later than fourteen days from the day on which we receive your notice of withdrawal. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.

If you requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided, up to the time you inform us of your withdrawal, compared to the full scope of services provided for in the agreement.

C10 Amendments for Ongoing Agreements

(1) The Provider may amend Part A and Part C with effect for ongoing Memberships and Plus agreements to the extent necessary due to changes in law or case law, or for technical reasons. Prices and the core of the agreed services remain unaffected.

(2) The Provider will announce amendments in text form at least six weeks before they take effect. If the Participant does not object within four weeks of receipt, the amendments are deemed accepted. The Provider will point out this consequence separately in the notice.

(3) If the Participant objects, the previous Terms continue to apply. In that case, the Provider may terminate the agreement with 30 days’ notice if continuing on the previous terms is unreasonable for the Provider; amounts already paid are refunded on a pro-rata basis.

C11 Individual Sessions on Request

(1) Individual sessions are not part of the Accelerator, Membership, or Plus. The Provider may offer them separately on request, also without another LYF offering.

(2) Date, duration, and price per session are agreed in advance in text form (e.g., by email or WhatsApp). The agreement is formed when the Provider confirms the session in text form. The confirmation includes these Terms and the withdrawal notice. All prices are final prices including statutory VAT.

(3) The session takes place as a video call. The fee is payable in advance, before the session. If the Participant cancels in time under paragraph 4 and no new date is agreed, the Provider refunds the fee.

(4) The Participant may cancel or reschedule a session free of charge up to 48 hours before it begins. For later cancellations or no-shows, the fee remains payable. The Participant remains free to prove that the Provider incurred no loss or a significantly lower loss.

(5) Consumers also have the right of withdrawal under Section C9 for individual sessions. If the session is to take place within the withdrawal period, Section C5(3) applies accordingly. The right of withdrawal expires once the session has been fully performed, provided the Participant expressly consented beforehand to the Provider beginning before the withdrawal period expires and acknowledged that they will thereby lose their right of withdrawal.
